Agreement

This website is operated by Michael Zhang, PhD, trading as Dr. Mike Zhang. By using the site you agree to these terms. If you do not agree to them, please do not use the site.

What the site is for

The site describes Michael’s background and his work, and gives you two ways to get in touch. It is for general information. Please read the disclaimer, which sets out what this work is and is not, and how to get help in a crisis. That page is part of these terms.

Booking a call

The booking link takes you to Cal.com, a separate service with its own terms and privacy policy. Booking a call is a request for a conversation. It does not create a coaching agreement and it does not oblige Michael to take on your work. He may decline where he is not the right person to help.

If you go on to work with him, the scope, the fees and the cancellation terms are set out in a separate written agreement. Where that agreement conflicts with these terms, that agreement wins for the work it covers.

Acceptable use

You agree not to:

• Use the site for anything unlawful, or to harass or harm anyone.
• Attempt to gain unauthorised access to the site, its host, or any account or system connected to it.
• Probe, scan or test the site’s security, or interfere with how it works for other people.
• Scrape or copy the site at scale, including for training machine learning models, without written permission.
• Misrepresent yourself as Michael or as connected to his work.

Content and ownership

The text, photographs, design and code on this site belong to Michael Zhang or to the people who licensed them to him. The Incumental name and the Incumental Method belong to Incumental. You may read the site, share links to it, and quote short passages with credit. Republishing whole pages, or using the photographs or the branding, needs written permission.

Podcast and interview thumbnails and titles belong to the publishers of those shows and appear here as references to their work.

Links to other sites

The site links to podcasts, publications and other organisations. Michael does not control those sites and is not responsible for their content, their accuracy, or how they handle your information.

Availability

The site is provided as it is. It is not guaranteed to be available without interruption or free of errors, and it may change or be taken down at any time.

Limitation of liability

To the fullest extent the law allows, Michael Zhang is not liable for any indirect, incidental or consequential loss arising from your use of this site, or from reliance on anything published on it, including any financial loss. Where liability cannot be excluded, it is limited to one hundred United States dollars or the amount you have paid for the use of this site, whichever is greater. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit that limit.

Indemnity

If your use of the site breaks these terms or the law and that causes a claim against Michael Zhang, you agree to cover the reasonable costs of dealing with that claim.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts in Clark County, Nevada, and you agree to those courts hearing it. If you use the site from somewhere else, you are responsible for whether that is lawful where you are.

If part of this does not hold

If a court finds any part of these terms unenforceable, the rest stays in force. Not enforcing a term on one occasion does not waive it.

Changes

These terms may be updated. The current version is always the one on this page, with its date at the top. Continuing to use the site after a change means you accept the new version.
